Welcome to Recuerdos, an online magazine offering subscription-based access to twice-monthly issues and related content (the “Service”). These Terms and Conditions (“Terms”) govern your use of my website http://www.recuerdos.bio (the “Website”) and any related services provided by Larissa Roberts (“I,” “me,” or “my”).
1. Acceptance of Terms
By accessing or using the Website, creating an account, providing your details to receive a free article, or purchasing a subscription, you agree to be bound by these Terms and my Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Recuerdos is an online magazine that publishes two issues per month. Subscribers gain unlimited access to all current and archived articles during their subscription period. Non-subscribers may be able to view a limited number of free sample articles or participate in our pre-subscription offer as described below.
3. Eligibility and Account Registration
You must be at least 18 years old or have the consent of a parent or guardian to use the Service. When you register for an account or provide your details for the free article offer, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Pre-Subscription Free Article Access
We may offer potential subscribers the opportunity to view one (1) full article from Recuerdos for free for a period of one month (“Free Article”) by providing their email address or other requested details (“Pre-Subscription Sign-Up”).
· Upon completing the Pre-Subscription Sign-Up, you will be granted access to one article of your choice (selected from the articles eligible for the promotion) for thirty (30) days from the date of sign-up.
· At the end of the thirty-day period, your access to that article will automatically expire unless you purchase a full subscription.
· The Free Article is for personal, non-commercial viewing only. You may not download, copy, distribute, or otherwise exploit the article.
· We reserve the right to modify, suspend, or discontinue the Free Article offer at any time without prior notice.
· Only one Free Article per person/email address is permitted unless otherwise stated.
5. Subscription Plans and Payments
We offer subscription plans on a recurring basis. By purchasing a subscription, you agree to pay the fees applicable to the selected plan. All fees are stated in GBP and are subject to applicable taxes.
· Billing Cycle: Subscriptions are billed in advance on a monthly / annual basis, as chosen by you at the time of purchase. You will be charged the subscription fee on the date you subscribe and on each renewal date thereafter.
· Automatic Renewal: Unless you cancel before the next billing date, your subscription will automatically renew for the same term. You authorise us to charge the payment method on file for the renewal fee.
· Price Changes: We may change subscription fees at any time. We will provide you with reasonable notice of any price change. If you do not agree with the new price, you may cancel your subscription before the change takes effect.
· Payment Method: You must provide a valid payment method. You represent and warrant that you are authorised to use that payment method. If a payment fails, we may suspend your access until payment is successfully processed.
6. Cancellation and Refund Policy
· Cancellation: You may cancel your subscription at any time through your account settings or by contacting me at admin@larissaroberts.com. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until that date.
· Refunds: Subscription fees are generally non-refundable. If you cancel, you will not receive a refund for the remaining portion of the current billing cycle. Exceptions may apply as required by applicable law. The free article is provided at no cost, and no refund or compensation is owed upon its expiration.
7. Intellectual Property Rights
All content available through the Service, including but not limited to articles, images, graphics, logos, designs, audio, video, and software, is the property of Recuerdos or its licensors and is protected by copyright, trademark, and other intellectual property laws.
· Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the content solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content without our prior written permission.
· Trademarks: The name Recuerdos and any associated logos are our trademarks. You may not use them without our consent.
8. User Conduct
You agree not to:
· Share your account credentials with others or allow multiple individuals to use a single-user account.
· Use any automated means (e.g., bots, scrapers) to access or collect content from the Service.
· Upload or transmit any viruses, malware, or harmful code.
· Use the Service for any unlawful purpose or in violation of these Terms.
We reserve the right to terminate or suspend your account if you violate these Terms.
9. Disclaimers and Limitation of Liability
· Service “As Is”: The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the content or the Website.
· No Professional Advice: Content in Recuerdos is for informational and entertainment purposes only. It does not constitute professional advice of any kind.
· Limitation of Liability: To the fullest extent permitted by law, Larissa Roberts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Larissa Roberts from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
11. Changes to Terms and Service
I may update these Terms from time to time. I will notify you of material changes by posting the updated Terms on the Website and updating the “Last Updated” date. In some cases, I may provide additional notice, such as by email. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
I also reserve the right to modify, suspend, or discontinue any aspect of the Service (including the free article offer and subscription features) at any time without liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Bristol, England except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property. You waive any right to participate in a class action or jury trial.
